Chapter 7 – Debt liquidation
Despite rumors to the contrary, the new bankruptcy code does not restrict most debtors from filing under Chapter 7 bankruptcy. This type of filing applies to people who have minimal assets or insufficient income and are saddled with overwhelming debts. Although the bankruptcy court applies remaining assets toward your debt, numerous exemptions exist, including cars, home equity, and other personal property, up to a certain value. Chapter 13 – Debt repayment
Filing for Chapter 13 bankruptcy offers people an opportunity to save all of their assets, or at least those that they can afford. This process can put a stop to foreclosure efforts that threaten repossession of homes, cars, or other valuable assets.
